Petitioner is directed to serve a copy of the revisional application upon Ms. Amita Gaur, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioner submits that the petitioner is innocent of the charges and was not the headmistress at the relevant period of time during which period the allegations have been made by the de facto complainant. The petitioner has been unnecessarily implicated after she has retired from services. Learned advocate for the State opposes such contentions advanced on behalf of the petitioner.
I have considered the submissions of both the parties and I am of the opinion that the issues canvassed by the petitioner is restricted to question of facts and the investigation of the case is in progress.
That being the scenario, no interference can be made ny this court at this stage. Petitioner would be at liberty to inform the Investigating Officer or the superior officer of the police and it would be for the Investigating Agency to come to their appropriate finding as to whether incriminating materials are appearing against the petitioner or not.
With the aforesaid observations, the present revisional application being CRR 1531 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
