May 19, 2025 25 ARDR (Rejected) CRM (M) 357 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, filed in connection with Berhampore Police Station Case No. 1860 of 2023 dated 26/12/2023 under Sections 489B/489C/34 of the Indian Penal Code.

And In Re :

Minarul Sekh ... Petitioner.

Adv. Sonali Das ... for the petitioner.

Adv. Joydeep Roy, Adv. Afreen Begum, ...for the State.

The petitioner is in custody for more than a year and renews his prayer for bail. Learned counsel for the petitioner submits that in rejecting his prayer on 18th September, 2024, this Court directed the learned trial Court to expedite the trial and conclude the same by delivery of judgment positively within four months from the next date fixed for recording of evidence.

Learned counsel for the State opposes the prayer and submits that two out of nine witnesses have been examined. There was delay in progress of trial since the Court has lying vacant. Learned Judicial Officer has joined in April, 2025 and trial shall be concluded within six months from the next date fixed for recording evidence.

Bail prayer of the petitioner was turned down by this Court earlier. There is no change of circumstance that calls for a favourable order at this stage.

Accordingly, the prayer for bail is rejected at this stage.

Learned trial Court is directed to take the proceedings to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties and in the light of the undertaking given by learned counsel for the State, in accordance with law.

The application for bail is disposed of.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
