The grievance of the petitioners pertains to interest on delayed payment of ex gratia amount pursuant to a Notification dated 15th September, 2008. It is submitted on behalf of the petitioners that pursuant to the said Notification the petitioners are entitled to interest on delayed payment of ex gratia amount.

The petitioners rely on diverse orders passed by different Benches granting payment of interest on delayed payment of ex gratia amount.

Advocate for the State respondents submits that they have no objection to pay either 8% or 6% interest on the on the delayed payment.

I have considered the rival submissions of the parties. I am satisfied that there has been a considerable delay in making payment of the ex gratia

amount to the petitioners and the petitioners are entitled to interest.

Under such circumstances, the respondents are directed to pay interest at the rate of 6% per annum on the delayed payment of ex gratia amount from the date of retirement till the actual date of payment within three months from the date of communication of this order. With the aforesaid directions, W.P.A. 10103 of 2023 stands disposed of.

There shall be no order as to costs.

Since no affidavit has been called for, the allegations contained in the petition are not admitted. Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
