The instant revisional application has been filed against the order dated 06.05.2011 passed by the learned Chief Judicial Magistrate, Barasat in connection with Barasat Police Station Case No. 1741/10, dated 22.09.2010, under Section 11(b)(h) of the Prevention of Cruelty to Animals Act, 1960 which corresponds to G.R. Case No. 3734/10 whereby passing an order issuing bailable warrant of arrest against the petitioner. The impugned order states as follows:

"It appears from the report of the I.O. that copy of order sheet dated 19.04.2011 and message copy was sent to Mrigan Roy and Debashree Roy, Member of Debashree Roy Foundation which was duly received by Arati Roy, mother of Mrigen Roy and Debashree Roy.

Again from 1.05.2011 to 03.05.2011, I.O. contacted with Mrigan Roy several times for shifting these dogs to Barasat Veterinary Hospital but till date they paid no heed.

In view of the order dated 19.04.2011 passed by this Court, this is no alternative but to issue W/A for compliance of this Court's order.

Let bailable W/A of Rs. 500/- each be issued against Mrigen Roy and Debashree Roy Members of Debashree Roy Foundation".

Perused the petition as well as the impugned order, this court does not find any infirmity or impropriety in the impugned order. Accordingly, this court is not inclined to interfere with the same.

Accordingly, the instant revisional application is dismissed.

Copy of the order be sent to the Department as well as learned trial court for immediate compliance. (Ananya Bandyopadhyay, J.)
