Learned advocate appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in the instant case pursuant to a statement made by a person in whose account money was transferred. The petitioner is in custody since 25th March, 2023 and his further detention is unwarranted as there is no recovery from him.

Mr. Nandy, learned Additional Public Prosecutor appearing on behalf of the State opposes the prayer for bail of the present petitioner and submits that the petitioner is history-sheeter and similar offences have been committed by him. Learned advocate for the State has taken the court through the case diary and pointed out the stage of investigation and the efforts, which are taken by the Investigation Officer to ascertain the allegations.

Having regard to the stage of the investigation at this stage, I am

not inclined to release the petitioner on bail having considered the materials, which are presently surfacing.

Petitioner would be at liberty to renew his prayer for bail after a fortnight.

Accordingly, the prayer for bail of the present petitioner is rejected. With the aforesaid observations, the application for bail, being CRM (SB) 81 of 2023 is disposed of.
