Mr. Abhishek Banerjee -For the petitioner The present proceedings are under Section 138 of the Negotiable Instrument Act.

Learned advocate for the petitioner is aggrieved as the case initiated in the year 2016 and till date the crossexamination of P.W. 1 is continuing. Learned advocate is further aggrieved by the fact that earlier an order for expeditious disposal of the trial was passed by a co-ordinate Bench in CRR 1416 of 2018, but in spite of the same, there has been no progress in the case.

I find that the next date has been fixed on November, 2023 from a date which was fixed in the month of February, 2023.

Having considered the stretch of time which is considered by the learned Magistrate to be convenient, I am of the view that because of paucity of time, it may not be possible for the judicial Magistrate, 10th Court, Alipur, 24 Parganas (South) to comply with the order of the High Court.

Accordingly, the proceedings being C 4046 of 2016 is transferred to the file of the learned Chief Judicial Magistrate, Alipur. Learned Chief Judicial Magistrate would issue notice to the accused persons on requisites being deposited by the complainant and prepone the date according to its convenience. On and from the date so fixed by the learned Chief Judicial Magistrate, Alipur once in a fortnight date should be fixed for the purpose of the present case so that trial of the case can be concluded by June, 2024. Any extension of time in this case should only be granted after permission obtained from the High Court, Calcutta. With the aforesaid observations, the revisional application being CRR 1534 of 2023 is disposed of. Pending application, if any, stands disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
