Petitioner has come up with the present writ petition, inter alia, praying for sanction of family pension due to death of her elder brother. Elder brother of the petitioner was an Assistant Teacher who retired on superannuation on 30th September, 1996. After superannuation elder brother of the petitioner received all benefits including pension. Elder brother died on 24th September, 2021. Now sister has approached this Court seeking mandamus upon concerned respondent authorities to sanction family pension in her favour.

Sanction of pension/ family pension in connection with an approved Assistant Teacher

working in Government aided school is governed by the Death -Cum- Retirement Benefit Scheme, 1981 (for short, "DCRB, 1981"). As per DCRB, 1981 after death of a teacher there is no provision to sanction family pension in favour of sister of deceased teacher.

Hence, no relief can be granted to the petitioner.

Writ petition stands dismissed.
