Allegedly, commercial quantity of contraband items was recovered from the possession of the petitioner. In view of the restrictions in Section 37 of the NDPS Act, we are not inclined to entertain the petitioner's prayer for bail.

However, the petitioner says that he has been in custody for more than three years. Charge was framed on March 7, 2019. There has been no significant progress in the trial after that. The last date for the trial was July 28, 2021. The next date for trial has been fixed as December 1, 2021. The petitioner says that at this pace, the trial would take long to conclude. We appreciate the anxiety of the

petitioner. He has been in custody for a long time. Accordingly, we request the learned Trial Court to make all endeavours to expedite the trial to the extent possible and conclude the same at an early date and preferably within a period of eight months from the date, if necessary, by fixing frequent dates of hearing. The petitioner shall be at liberty to apply to the learned Trial Court for preponement of the next date.
