The case is under sections 498A/304B of the IPC being Sessions Case No. 16 of 2014 pending before the ld. Addl. District and Sessions Judge, Fast Track Court, Durgapur.

The records of the case also reflect that there has been a design to frustrate the process of the criminal court. As such, I direct the Deputy Commissioner of Police in charge of Andal P.S. to act as a Nodal Officer of this case for ensuring the availability of the witnesses on the date so fixed.

The ld. trial court i.e. ld. Addl. Dist. & Sessions Judge, Fast Track Court, Durgapur would fix a schedule

consisting of four dates and fix such schedule once in a month.

In case, any witness is not present on the date so fixed, in that case, the Deputy Commissioner of Police in charge of the case, who would be acting as a Nodal Officer of the case, would submit a report regarding the reasons for non-availability of the witnesses before the ld. trial court. All efforts be taken to conclude the prosecution witness by 31st of December, 2024.

No unnecessary adjournments be granted to any of the parties. Ld. Public Prosecutor conducting the case would produce the materials, exhibits and documents on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. trial court so that the trial of the case is concluded by 31st of December, 2024. The trial of the case would continue in spite of any resolution of the local Bar and the participating advocates in any manner or the other will not stall the proceedings in spite of such resolution.

With the aforesaid observations, CRR 1615 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
