Heard learned counsels for the parties.

It appears from the report that investigation is in progress. The private respondent was arrested in connection with the present matter and was subsequently released on bail. The matter is pending before the learned Magistrate for permission to take the specimen signature of the accused/ private respondent. The bank account has been frozen. The petitioner seeks recovery of the amount frozen by the private respondent. The petitioner is at liberty to approach the appropriate forum for redressal of his grievance.

Since it prima facie appears that there is satisfactory progress in investigation of the case, no fruitful purpose shall be served by keeping the writ petition pending. The same is accordingly disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
