Mr.. Narayan Prasad Agarwal along with Mr. Pratick Bose learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Legal Remembrancer is requested to regularize the appointment of Mr. Narayan Prasad Agarwal and Mr. Pratick Bose learned advocates in due course.

Learned Advocate on behalf of the State appears and submits that the revisional application was directed against the proceeding bearing Case No. 263M/2008 under Section 128 Cr.P.C. From the order of this court dated 22.6. 2011, it is found that the petitioner was directed to deposit Rs. 3,000/- with the learned court below within two weeks and on that condition D.W issued by the learned Magistrate will be stayed but failing which there will be no order of stay.

From the record, I do not find anything done by the petitioner in compliance with the order of this court dated 22.6.2011. In the aforesaid view of the matter, I do not find any scope to interfere with this order of the learned Magistrate. Thus, the revisional application stands dismissed. The learned Registrar (Judicial Services) is requested to communicate this order to the learned Chief Judicial Magistrate, Malda forthwith.
