Learned advocate appearing for the petitioners submits that the petitioner no. 1 was arrested and was subsequently granted bail by the jurisdictional Court. He submits that the petition be treated as not pressed for the petitioner no. 1. So far as the petitioner no. 2 is concerned, he submits that the petitioner no. 2 was falsely implicated. Learned advocate appearing for the State draws the attention of the Court to the contents of the case diary. Considering the nature of involvement of the petitioners and considering the fact that one of the coaccused was granted bail by the jurisdictional Court, we are inclined to grant anticipatory bail to the petitioner no. 2, Amit Biswas @ Amit Vishwash. So far as the petitioner no. 1 is concerned, the application is treated as not pressed on his behalf.

Accordingly, we direct that in the event of arrest, the petitioner no. 2 shall be released on anticipatory bail upon

furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner no. 2 shall appear before the Court below and pray for regular bail within four weeks from date and on a further condition that the petitioner no. 2 shall meet the Investigating Officer once in a fortnight.

Prayer for anticipatory bail of petitioner no. 2 is allowed.

CRM 4342 of 2021 is disposed of.
