Petitioner is in custody for seven months. He submits he has been falsely implicated. Accordingly, he prays for bail. 2.

Learned Advocate for the State opposes the bail prayer. He submits petitioner was involved in trafficking narcotics above commercial quantity.

We have considered the materials on record.

Statements of witnesses and contemporaneous document i.e. seizure memorandum show recovery of narcotics above commercial quantity i.e. 61 kgs. of ganja from petitioner and four others.

In view of the aforesaid incriminating materials and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner. 5.

Accordingly, the prayer for bail of the petitioner is rejected.
