No. 14 GB/SD CRM (NDPS) 531 of 2022 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 20.5.2022 in connection with Kandi Police Station Case No. 555 of 2021 dated 20.10.2021 under Sections 22(c)/29 of the NDPS Act read with Section 27A of the Drugs and Cosmetics Act.

Learned counsel for the petitioners contends that the petition is not being pressed insofar as petitioner no.2 is concerned. However, the petitioner no.1 is already in custody for about 218 days and seeks bail.

Learned counsel appearing for the State contends that the petitioners are habitual offenders and that a substantial quantity, that is about 7350 bottles, of the contraband article was recovered from the petitioners.

In such view of the matter, we are not inclined to grant bail to the petitioners.

Accordingly, CRM (NDPS) 531 of 2022 is rejected against the petitioner no.1 and is rejected as not pressed insofar as the petitioner no.2 is concerned.
