1. Learned advocate representing the State respondents submits that the petitioner performed the work in accordance with the work order issued and accordingly FTO was generated.

2. According to the Union of India, prior concurrence of the Central Government was not obtained by the Programme Officer before floating the tender. The work plan was also not submitted. Apart from that, there are several other anomalies for which payment cannot be released.

3. The Block Development Officer being the Programme Officer of MGNREGA is directed to follow up the matter with the Ministry of Rural Development, Government of

India and intimate the petitioner the fate of his claim for payment.

4. The State as well as the Central Government shall take steps in the matter strictly in accordance with law. If any amount is found due and payable to the petitioner, then the same shall be disbursed without any further delay.

5. Steps shall be taken by the Block Development Officer at the earliest and fate of the petitioner's claim shall be made known to the petitioner positively within twelve weeks from the date of communication of this order.

6. The writ petition stands disposed of.
