Mr. Tanmoy Mukherjee Ms. Sulagna Mukherjee Ms. Sujantna Mukherjee ....for the petitioner Mr. Mainak Ganguly Mr. Shankar Mukherjee ....for the opposite party No.1 This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 4th Court at Alipore to dispose of the application filed by the defendant No.1 expeditiously.

Mr. Mukherjee, learned advocate appearing for the petitioner submits that the defendant No.1 has filed an application praying for allowing the parties to put in the stamp paper in terms of the assessment made by the Sherestader in terms of the final decree dated May 4, 2024.

The opposite party No.1 is represented by the learned advocates. He however, does not have any objection with regard to the direction of expeditious hearing of such application.

In view of the order sought and proposed to be passed, this Court is of the considered view that there is

no necessity to issue notice upon the other opposite parties.

In the light of the submissions made by the learned advocate of for the petitioner and the opposite party No.1, CO 1574 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Div.), 4th Court at Alipore to take up the hearing of the application filed by the defendant No.1 on the next date fixed i.e. on July 10, 2025 and to dispose of the same as expeditiously as possible but positively within a period of one month from the next date fixed without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
