1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is serving in an ICDS Project. She seeks transfer from Maheshtala ICDS Center to South 24 Parganas ICDS Center.

3. The prayer of the petitioner is pending consideration.

4. Though no specific provision of law has been produced before this Court permitting transfer of ICDS workers but from the documents annexed to the writ petition, it appears that prayer of the petitioner for transfer was forwarded by the District Programme Officer (ICDS) South 24 Parganas to the Director of ICDS in October, 2023.

5. The documents of the petitioner were again resubmitted by the Child Development Project Officer, Maheshtala (U) ICDS Project to the Joint Director of ICDS in February, 2024.

6. There is no response from the authority till date.

7. As it appears that the request of the petitioner for transfer is pending consideration for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the Joint Director of ICDS being the respondent no. 4 herein to take a decision on the prayer of the petitioner seeking transfer in accordance with the prevailing rules and guidelines.

8. Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order.

9. A reasoned order shall be passed by the aforesaid respondent and communicated to the petitioner immediately thereafter.

10. Learned advocate for the petitioner is directed to forward a copy of the representation seeking transfer along with all documents in support of her prayer to the aforesaid respondent at the time of communicating the order of the Court.

11. The writ petition stands disposed of.

12. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
