APP Mr. Sandeep Prasad Shaw ... for the State-respondent(s) Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 11 months and the petitioner has been implicated on the basis of alleged recovery of 50 bottles of phensedyl and Wincerex cough syrup.

Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the chemical examiner's report.

The records of the case reflect that charge-sheet has been submitted. However, there has been no progress in the case as other accused persons are absconding. Having considered the period of detention, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Malati Choudhury @ Chowdhury shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 3rd Court, Dakshin Dinajpur at Balurghat.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Dakshin Dinajpur without prior permission of the learned Special court/trial court.

Accordingly, CRM (NDPS) 909 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
