The petitioner says that there was no recovery of contraband item from him and he has been implicated merely on the basis of statements made by the co-accused persons. The State produces the case diary and draws our attention to the Seizure List.

We have considered the material on record. We find that commercial quantity of codeine mixture was recovered from the possession of the petitioner. In view of the restriction in Section 37 of the NDPS Act, we are not inclined to entertain the petitioner's prayer for bail.

The application for bail is, thus, rejected.

CRM 4360 of 2021 is, accordingly, dismissed.
