The charge against the petitioner is under Section 6 of the POCSO Act.

The victim was six years old when the alleged incident took place. The petitioner was 45 years old. We have seen the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure. The girl vividly described the heinous act that the petitioner indulged in.

In view of the serious nature of allegation against the petitioner and the prima facie incriminating material on record, although charge-sheet has been filed, we are not inclined to allow the petitioner's prayer for bail at this stage. The application for bail being CRM 4358 of 2021 is, thus, dismissed.
