1. Petitioner seeks quashing of GR Case No. 3861 of 2024 arising out of Falta Police Station Case No. 327 of 2024 dated December 1, under Sections 420/467/406/468/471 of the Indian Penal Code, 1860 pending before the learned Chief Judicial Magistrate, Diamond Harbour, South 24 Parganas.

2. Learned advocate appearing for the petitioner submits that, the alleged incident is of 2019. The first information report was sought to be registered on December 1, 2024. There is unexplained delay in lodging the first information report. Moreover, the first information report was lodged as a counter-blast to three writ petitions filed by the writ petitioner.

3. Police complaint taken as it stands makes out a case of commission of cognizable offence.

4. Investigations are yet to be completed.

5. As on the date, therefore, I am not in a position to arrive at a finding that, the complaint does not disclose cognizable offence or that complaint is so absurd that no investigation is required to be conducted.

6. The two grounds urged in this revisional application that is of delay in lodging the first information report and that the criminal complaint was lodged as a counter-blast may be availed of at the trial, if it so occurs.

7. In view of the discussions above, CRR/1971/2025 is dismissed.
