Mr. Jayanta Narayan Chatterjee, learned advocate appearing for the petitioners submits that this revisional application was preferred at a stage when the case was pending before the learned trial court. However, he has instructions that in the meantime trial has progressed. Mr. Sandip Chakraborty, learned advocate appearing for the State has submitted a report of Additional O/C, Manicktala P.S. which has been forwarded by Officer-inCharge, Homicide Squad, Detective Department, Lalbazar, Kolkata. The said report dated 27.09.2021 be kept with the record.
On perusal of the said report, it appears that 37 prosecution witnesses have already been examined and the next date of trial has been fixed on 11.11.2021.
Mr. Kaushik Gupta, learned advocate appears on behalf of the opposite party no.2.
Mr. Chatterjee, learned advocate for the petitioners has submitted that in view of progress of the trial for a considerable period, the petitioners do not intend to proceed with this revisional application.
In view of the submission, so advanced by the learned advocate for the petitioners, CRR 1469 of 2012 is dismissed as not pressed.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
The petitioners would be at liberty to canvass the points, agitated in this revisional application, if any, at the stage of final argument of the case.
