By presenting the writ petition challenge has been thrown to the order of the Chairman, Nadia District Primary School Council dated 16th March, 2009 whereby prayer of the petitioner for being appointed on compassionate ground due to death of her mother on 9th June, 2000 was spurned.

On perusal of the order dated 16th March, 2009 issued by the Chairman, Nadia District Primary School Council, this Court does not find infirmity. Since it has been rightly observed by the Chairman that object of providing compassionate appointment is to eradicate immediate financial hardship due to untimely death of bread-earner. In the present case, mother of the petitioner died on 9th June, 2000 and prayer for

appointment on compassionate ground was refused vide order dated 16th March, 2009 which has been challenged by presenting this writ petition precisely after 16 years. Delay in approaching the Court seeking appointment on compassionate ground goes to show that there was no immediate financial assistance required to tide over financial constraints. Moreover, at the time of death of mother of the petitioner on 9th June, 2000, the petitioner was minor and right of a minor candidate cannot be preserved for appointment on compassionate ground till such candidate attains majority unless the same is provided in the scheme of appointment on compassionate ground.

Hence, no relief can be granted to the petitioner. Writ petition stands dismissed.
