Ghosh .......For the Petitioner Ms. Chaitali Bhattacharyya Mr. Subhendu Roy Choudhury .....For the State The petitioner was appointed as a school teacher in 1973 and retired in 2001. Now he has come up with an application on the basis of one circular issued by the Director of School Education, which is at page 36, dated 9th May, 1984. He wants to take advantage of this circular as he submits that his pay scale is to be considered as Honours Graduate as in the said circular some clarification has been made to another office Memo dated 21.11.83 and it is stated that B.Com (old course) may be considered as Honours Graduate. From the documents annexed to this writ application it is found that the writ petitioner passed pre-university examination in Arts and thereafter he had undergone B. Com. (old course). To the question of this court as to whether a person who initially passed in Arts in pre-university examination could be admitted and

undergone B. Com. Course, there is no reply of the petitioner. Moreover, the circular dated 9th May, 1984 (at page 36) does not say about B. Com. Part-I examination. It says about B. Com. (old course) which does not mean that B. Com. Part-I is also covered under the said circular. For the reasons of delay of eighteen years in coming to this court and for other reasons stated above specially that his degree is not covered by the said circular dated 9th May, 1984, I do not find any merit in this application and this writ application is dismissed.
