The petitioner has come up before this Court praying for a direction for expeditious disposal of NDPS Case No.N-24 of 2021, pending before the learned Judge under NDPS Act, Barrackpore. It is ascertained from the submission made both by the learned Advocate for the petitioner as well as the learned Public Prosecutor-inCharge that next schedule of examination of the witnesses has
already been fixed by the Trial Court on 22nd August, 2022, 23rd August, 2022 and 24th August, 2022.
Learned Advocate for the petitioner submits that the instant revision may be disposed of directing the learned Court below to utilize the above stated schedule for examination of the chargesheeted witnesses. It is ascertained from the submission made by the learned Public Prosecutor-in-Charge that in all, there are 7 charge-sheeted witnesses. All the witnesses are police personnel. Therefore, the instant revision is disposed of directing the learned Special Judge, Barrackpore to serve summons upon the charge-sheeted witnesses through the Commissioner of Police, Barrackpore Police Commissionerate.
The Commissioner of Police, Barrackpore Police Commissionerate may be directed to ensure attendance of the charge-sheeted witnesses on the dates fixed as per the schedule for recording their evidence before the Trial Court as per the summons issued by the Court below.
The learned Advocate for the petitioner is at liberty to communicate a server copy of this order to the learned Trial Judge for information and necessary action.
