The matter is listed today as "Contested Application". On call none appears for the petitioner and the opposite parties. There is no interim order staying further proceeding of the Misc. Case or the Misc. Execution. The petitioner challenged the order dated 19.12.2012 passed by the learned Additional Sessions Judge, Fast Track Court-I, Barrackpore in criminal revision no.95 of 2011 against the judgement and order dated 21.02.2011 passed by the learned Judicial Magistrate, 3rd Court, Barrackpore, in Misc. Execution No.51 of 2013. By this application the petitioner has practically challenged the claim of the opposite parties pending for the last 20 years. Initially the revision was dismissed on 18.02.2015 for default and restored on 21.08.2015.

I find that till date the petitioner has not taken steps upon the opposite parties and no affidavit of service has been filed. Under the facts and circumstances, criminal revision is dismissed for default. Let a copy of this order be sent to the court of learned Additional Sessions Judge, Fast Track Court-I, Barrackpore, for information and necessary action.
