These two revisional applications are arising out of the same matrimonial suit being Matrimonial Suit No. 56 of 2017 as such are taken up for analogous hearing and disposal.
The said suit is pending before the 6th Court of learned Additional District Judge District.
Parganas (South) at Alipore.
The husband, the petitioner of the said matrimonial suit by the revisional application under Article 227 of the Constitution of India being C.O. 1220 of 2021 is praying for a direction upon the learned Trial Judge for expeditious disposal of the said suit.
The wife, the respondent of the said suit in the other revisional application being C.O. 654 of 2021 is complaining that the learned Trial Judge is proposing to dispose of the said suit without
the arrear alimony is being fully paid. Mr. Aniruddha Chatterjee learned advocate for the husband submits that during the pendency of the present revisional applications the husband has cleared all the arrears amount of alimony.
Mr. Raghu Nath Chakraborty, learned advocate for the wife does not dispute such submission of Mr. Chatterjee.
The matrimonial suit is pending since 2017. The nature of the said suit demands its expeditious disposal.
Under the aforesaid circumstances C.O. 654 of 2021 and C.O. 1220 of 2021 are disposed of by requesting the learned Trial Judge to dispose of the said suit expeditiously preferably within a period of four effective available working months of the said Court from the date of communication of this order and in doing so shall not grant any unnecessary adjournment to either of the parties.
There shall be no order as to costs.
Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
