The learned Counsel appearing for the petitioner submits that the petitioner has made a representation on 16th April, 2021 before the Secretary, Ministry of Road Transport and Highways, Government of India but such representation has not been considered by the Secretary, Ministry of Road Transport and Highways, being the respondent no. 2 in the instant writ petition till date.

Mr. Ghosh, learned Counsel appearing for the respondents is present.

Heard both the parties.

The learned advocate-on-record of the petitioner is requested to serve a copy of this writ petition along with a copy of this order to the Secretary, Ministry of Road Transport and Highways, Government of India, being the respondent no. 2 in the instant application within seven days from today.

As the representation has not been considered till date, I request the respondent no. 2 to consider the representation of the petitioner after giving an opportunity of hearing to the petitioner, to allow the petitioner to produce all necessary documents at the time of hearing

and pass a reasoned order within a period of twelve weeks from today. The reasoned order should be communicated to the petitioner at an earliest.

I make it clear that I have not gone into the merits of the writ petition, all the issues are left open to the Secretary, Ministry of Road Transport and Highways, Government of India, being the respondent no. 2 to be decided by him.

Since no affidavits have been invited, the allegations contained to the writ petition are deemed not to have been admitted by the respondents.

The writ petition is disposed of.

There will be no order as to costs.

The parties shall act in terms of the copy of the order downloaded from the official website of this Court. (Rajarshi Bharadwaj, J.)
