The writ application has been preferred being aggrieved by the certificate issued under Section 8 of the EPF Act dated 06.04.2026.

It is submitted by the learned counsel for the petitioner that challenging the order under Section 7A of the EPF Act dated 24.12.2025, the petitioner has preferred an appeal before the Central Government Industrial Tribunal which has been registered as EPF Appeal no. 16 of 2026. The said appeal was filed in March, 2026.

Admittedly, there is no regular Presiding Officer at the Tribunal and it is submitted that as such the stay application could not be moved.

Considering the said facts, the writ application is disposed of, on hearing the parties, with the direction that the impugned notice dated 06.04.2026 along with the order under Section 7A of the EPF Act dated
24.12.2025 be stayed till the matter is taken up for admission hearing along with the application for stay by the learned Tribunal.

It further appears that in spite of having notice about the appeal being preferred, the respondent authorities have proceeded to take coercive action against the petitioner.

Accordingly, it is directed that the respondent authorities shall not take any coercive action against the petitioner until further orders by the learned Tribunal.

Writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.
10.
Interim order, if any, stands vacated.
11.
Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
