Petitioner has approached this Court being aggrieved by the final report which was filed in connection with Eco Park Police Station Case No. 287/2023 dated 01.02.2023. According to the petitioner the accused was getting pension from Bangladesh, but in spite of the same the investigating officer of the case after registering the same under the relevant provisions of the Foreigners Act, finally arrived at a conclusion relating to that there was 'mistake of fact' so far as the issues relating to investigation under the relevant act is concerned.
State has submitted a report. Report reflects that the Inspector-in-charge, Eco Park Police Station has categorically stated that earlier the final report which was submitted in connection with Eco Park Police Station Case No. 287/2023 dated 01.02.2023 was challenged by the present petitioner in WPA 23326 of 2024. The co-ordinate bench was pleased to dispose of the writ petition stating that if the petitioner is aggrieved by the conclusion arrived at by the investigating officer which was based on the available documents, the petitioner would be at liberty to approach the jurisdictional court. Be that as it may, since earlier a writ petition has already been disposed of I do not find any reason to interfere with the present writ petition. Accordingly WPA 10133 of is dismissed.
