Versus

State of West Bengal Mr. Kishan Ray Mr. Pronojit Roy ....

For petitioner Ms. Manisha Sharma ....

For State A copy of the application is served on the learned advocate appearing for the State in Court today. Mr. Ray, learned advocate appearing on behalf of the petitioner submits that in a case involving offence under Sections 363/365/366A/120B/34 of the Indian Penal Code, 1860 read with Section 6 of Protection of Children from Sexual Offences Act the petitioner was granted anticipatory bail on 28th November, 2014 and the petitioner surrendered on 11th December, 2014 before the learned Court below and obtained regular bail. Subsequently during Covid period she could not appear before the learned trial Court and ultimately the learned Additional Chief Judicial Magistrate at Basirhat, District 24 Parganas (North) by an order dated 4th March, 2022 issued warrant of arrest against the petitioner in connection with Hasnabad Police Station Case No.242 of 2013 dated 30.05.2013.

Accordingly, the instant revisional application has been filed with a prayer for setting aside that order.

Considering the facts and circumstances appearing in the record I find it justified staying the execution of

warrant of arrest till 30th June, 2022. In the meantime, the petitioner is directed to surrender before the trial Court. With the above direction, CRR 1828 of 2022 stands disposed of.
