Naskar, Advocates ... for the State This Court by an order dated 17.01.2023 had decided the main issues raised in the petition and adjourned the petition for limited purpose of filing the undertaking of the competent authority before this Court disclosing the fresh cut-off date before which the work of compensatory plantation will be completed.

Affidavit of undertaking dated 25.01.2023 filed by the Assistant Engineer attached to Public Work Department states that plantation of 4130 number of different trees on both sides of Tarakeswar-Chawkdighi Road as per plantation plan approved by Forest Range officer, Hooghly SF Range will be completed by 31st March, 2024 and widening and strengthening work of the said Tarakeswar-Chawkdighi Road will be completed by 31st December, 2023 subject to any force majure. Learned counsel for the State has also filed undertaking submitted by Assistant Engineer, PWD, Hooghly to the Divisional Forest Officer, Howrah Division

WPA(P) 238 of 2022 by way of communication dated 06.02.2023 wherein regarding plantation it is stated that developer will make plantation similar to the plan as earmarked at the time of preparation of plantation plan and duly approved by Forest Range Officer and also statement is made in respect of the soil work and the species of the trees and in respect of source of seeds and seedlings for plantation and the maintenance of the same for a period of 5 years.
