It appears from the record that the dispute is with regard to residence in a property located at Aishtala Kabiraj, under Ranaghat Police Station, Nadia.

The petitioner and the private respondents are brothers. Upon receipt of a complaint of alleged assault from the petitioner, the Ranaghat Police Station has conducted investigation and found that the writ petitioner may not have been residing in the said property for past three years. The private respondent has resisted the petitioner from entering into the property claiming that the petitioner has no right to the same.

The Ranaghat Police have not registered any FIR given the fact that the matter relates to a family dispute. This Court is of the view that the remedy of the petitioner would lie before a civil court and this Court does not see any inaction on the part of the Ranaghat Police Station.

In view of the above, the writ petition is disposed of. Inspector-in-Charge, Ranaghat Police Station has submitted a report dated 29th July, 2021 in the form of instructions to the learned Government Pleader. The same is taken on record.
