....Petitioners Mr. Gunjan Kumar Singh ...For the petitioners Petitioners seek quashing of First Information Report being Dhubulia Police Station Case No. 170 of 2023 dated April 14, 2023 under Section 448/323/379/506/34 of the IPC, 1860. Learned advocate appearing for the petitioners submits that the incident of assault occurred out of a family dispute. There may be civil disputes between the private parties. Issue before the Criminal Court is whether any cognizable offence was committed or not.

FIR was investigated into and a charge sheet under Section 448/323/506/34, 1860 was submitted.

At this stage, I am not in a position to arrive at a finding that there is no basis to the criminal complaint or that the criminal complaint is so absurd for which the Court needs to quash the same.

C.R.R. 1978 of 2025 is, therefore, dismissed. (Debangsu Basak, J.)
