Counsel for the petitioner submits that the private respondent, who is the brother of the petitioner, is constructing on a portion of his land. The writ petitioner also complains that the private respondent has threatened the writ petitioner with harm and consequences.

This Court is of the view that the disputes between the petitioner and his brother are civil in nature and the same may be agitated before the Civil Court. However, the Officer-in-Charge, Nalhati Police Station, is directed to see that there would be no breach of peace in the locale.

With the above observations, WPA 10882 of 2021 is disposed of without, however, any order as to costs.
