The instant appeal arises out of an order of acquittal dated 31.01.1997 passed by the learned Metropolitan Magistrate, 11th Court, Calcutta in Case No. C/357 of 1993.

In the above premises, the instant appeal is dismissed for nonprosecution. The representative of the appellant is present in Court today. His personal appearance is noted and dispensed with. Copy of the order and lower court records be sent to the trial court for due compliance.
