The petitioner prays for dispensing his personal appearance in the day to day proceedings before the learned trial court being the learned Chief Judicial Magistrate, 2nd Purba Burdwan. The petitioner is on bail and thereafter filed application under Section 205 of the Code of Criminal Procedure. It is settled proposition of law particularly with regard to the undertakings and abiding by the conditions imposed by the learned Trial Court.

The petitioner may not be directed to physically appear regularly before the learned Trial Court if the evidence can proceed in the absence of the present petitioner and petitioner categorically states that he will not take up any higher forum or in the subsequent stage of the proceeding any issue relating to the factum that since the evidence was recorded in his absence he has been prejudiced thereby.

date has been fixed on August 07, 2024 for plea. Learned Judicial Magistrate, 2nd Court, Purba Bardhaman would firstly allow the application under Section 205 of the Code of Criminal Procedure and thereafter proceed with the case in accordance with law. With the above observation the revisional application CRR No. 1627 of 2024 is disposed of.
