Petitioners are aggrieved as the representation dated 14.04.2025 was not considered by the Officer-inCharge of Mahishadal Police Station. Petitioner no.1 is the father who complains against the son and the daughter-in-law. Petitioners further allege that earlier the petitioners were thrown out from the residence but at the behest of the police authorities, their possession was restored. Presently the petitioners are at their residence but the private respondents are attempting to throw them out.
State has submitted a report prepared by the Officer-in-Charge, Mahishadal Police Station which reflects that a matrimonial dispute exists, consequent to which Mahishadal P.S. case no. 778/2023 was registered for investigation. The police authorities on conclusion of investigation submitted charge-sheet in connection with
the said case. There is already a dispute existing between the petitioners and their son and relatives.
Be that as it may, since the petitioners are apprehensive that they may be thrown out of their residence, I am of the view that in case the petitioners complain of such inconveniences, police authorities would ensure that if petitioners are residing at the premises referred to in the writ petition and are feeling y insecured because of any overt acts at the behest of the private respondents the same may be addressed.
With the aforesaid observations WPA 10143 of 2025 is disposed of.
Report so submitted by the State be kept with the record.
Copy of the report be handed over to the learned advocate appearing for the petitioners.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
