Five petitioners in this writ petition challenge the steps taken by the South-Eastern Railway in accepting the bid of the third respondent thereby rejecting the bid of the petitioners without any valid reason.

Learned advocates representing the railway and the private respondent-successful bidder place on record the letter of acceptance dated April 3, 2025 accepting the bid of the private respondent.

Learned counsel for the private respondent submits that work in question has already commenced in April 2025.

Learned counsel for the petitioners stresses on the fact that his clients submitted a bid of higher amount and the railways would have earned more, had the petitioners been accepted. The said
fact is disputed by the respondents. The court is not inclined to enter into any disputed question of fact.

As the petitioners appear to have approached this court at a belated point of time, this court is not inclined to exercise jurisdiction in this matter. 6.
The writ petition thus fails and is hereby dismissed.

It will be open for the petitioners to approach the competent forum for remedy, if so advised.

Supplementary affidavit and affidavit of service filed in court be taken on record.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.
