1) We are not inclined to interfere with the order impugned before us. The learned single Judge thought it fit to send the dispute for mediation. No orders were passed on merits.

2) We are informed that the mediation has failed. Thus, the matter shall be decided by the learned single Judge having determination.

3) Mr. Ghosh submits that the issue of rehabilitation and the mode and manner in which the Lansdowne Market should be developed, was already decided in earlier proceedings.

4) We are of the view that, Mr. Ghosh and/or his client would be at liberty to rely upon those decisions when the adjudication takes place.

5) The matter will appear before the learned Court, after the Mediator files his report. Liberty to Mention.

6) All issues are kept open.

7) Accordingly, the appeal and the connected application are disposed of.

8) Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
