Such application is allowed.
The petitioner is directed to add them as party respondent. From the writ application, it appears that the petitioners have challenged the interview list dated 21st June, 2021 published by the West Bengal Central School Commission.
Learned advocate for the petitioner has intimated this court that the allegation of the
petitioners are in respect of the marks awarded to them as appears from the interview list dated 21st June, 2021 and further allegation is that untrained candidates have been named in the interview list. Other allegation is non-publication of total number of vacancies.
In respect of different allegations, this court has already passed an order in W.P. No. 10789 of 2021 (Abhijit Ghosh vs. State of West Bengal & Ors.) granting liberty to the aggrieved candidates to file representation to the School Service Commission and the School Service Commission has also given certain directions. That order was passed by this court on 9th July, 2021. In compliance of the court's earlier direction passed in the above-mentioned matter, the West Bengal Central School Service Commission had published a detailed interview list giving the break up of marks of the candidates and the reasons for not bringing some candidates in the interview list.
In view of the said order passed by this court on 9th July, 2021, I do not find anything further is required to be adjudicated by this court in respect of above allegations of the writ petitioners as they have full liberty to approach the West Bengal Central School Service Commission by filing representation individually (not collectively) ventilating their grievances. In such a case the Commission will give them an opportunity of hearing and would pass a reasoned order.
The present application is in respect of a nonexistent interview list dated 21.6.2021 (Annexure-P9) and therefore this application has become infructuous.
In this view of the matter, this writ application is not entertained and the same is dismissed. No costs.
