As the prayer of the petitioner is innocuous, the matter is being taken up in the absence of the learned advocate for the municipality.

The petitioner alleges that there has been sheer wastage and misuse of municipal water through a municipal tap installed in front of the house of the petitioner. It is submitted that the municipal authorities are not regulating the use of such tap and the tap has been running constantly and the water from the said tap, which is only meant for drinking, is being used for all kind of purposes and the tap is also not closed after operation by the persons in and around the locality, which has resulted in sheer wastage of the drinking water. It is submitted by the petitioner that

the tap had been installed only for supply of drinking water for the people of the locality and such wastage of water amounts to misuse of natural resources. The municipal authorities should regulate the use of such municipal taps in the locality and ensure that the water supply is not misused by anybody.

The petitioner has made a representation to the Chairperson, Board of Administrator, English Bazar Municipality dated November 25, 2020. Let the said representation be considered by the municipality in accordance with law. The municipality upon consideration of the representation and upon making an inspection of the locale, may take such measures to ensure that the natural wealth of the country is not wasted in such a careless and indiscriminate manner.

Accordingly, the writ petition is disposed of. There will be however no order as to costs.
