Mr. Prasad Bhattacharyya ...for the petitioner This revisional application seeks expeditious disposal of Money Execution Case No.91 of 2024 presently pending before learned Judicial Magistrate, 4th Court, Alipore arising out of A.C. Case No.2210 of 2017.

It is alleged that despite an interim order passed by the Trial Court on 18th October, 2023 which awarded Rs.30,000/- towards maintenance for the petitioner and her daughter. Due to nonpayment, she initiated aforesaid Execution proceeding. The opposite party/husband has wilfully defaulted and is evading proceeding and, therefore, she seeks a direction by this Court for time bound disposal of the said execution proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, the service of copy of application upon the opposite party is dispensed with. Having considered the submissions made on behalf of the petitioner, I find that the prayer made by the petitioner is justified

in view of the long pendency of the proceeding and, therefore, is required to be allowed in order to secure the ends of justice. In view of above, CRR 1907 of 2026 is disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the said proceeding being Money Execution Case No.91 of 2024 and make its best effort to conclude the entire proceeding preferably within a period of three months from the next date of hearing.

This order is passed invoking this Court's jurisdiction under Section 529 BNSS.
