Bikash Ranjan Bhattacharyya, learned Senior Advocate for the petitioner submits that his client was enjoying security from the State while he was a member of a particular political party. Since after the change of parties sometime in April, 2021, the personal security has been withdrawn.

Mr. Amitesh Banerjee, learned Senior Counsel for the State submits that the petitioner has at least 9 charge sheets and several other criminal proceedings against him. There are other criminal complaints pending against the petitioner. It is submitted that during the last assembly election, the petitioner was using his security to intimidate people. It is based on the

complaint received from an Election observer that the security of the petitioner has been withdrawn.

In view of the subjective nature of the decision taken by the State which otherwise cannot be interfered with, no relief can be granted to the petitioner.

However, it is ordered that the State shall ensure that the petitioner is able to move around and live peacefully and the Officer-inCharge, Ratua Police Station shall take necessary steps to protect the petitioner against any perceivable threat.

With the aforesaid directions, WPA 10895 of 2021 is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
