The instant application filed under Article 227 of the Constitution of India with a prayer for disposal of the Misc. Appeal being No. 149/2012 pending before the learned District Judge, Hooghly expeditiously. It is stated by the petitioners that they filed an appeal before the Court of learned District Judge, Hooghly at Chinsurah challenging the order no. 47 dated 12.09.2012 passed by the learned Civil Judge (Junior Division), 2nd Court at Chandernagore in connection with Title Suit No. 44/2010 and thereafter several adjournments were granted by the Court. Finding no other alternative the petitioners have filed this instant application before the Court with a prayer for expeditious hearing of the appeal pending before the First Appellate Court.

Although parties are not present before the Court but I feel for the ends of justice, an order may be passed directing upon the learned District Judge, Hooghly to dispose of the Misc. Appeal being No. 149/2012 pending before that Court.

Accordingly, learned District Judge, Hooghly is hereby directed to dispose/hear the Misc. Appeal being No. 149/2012 pending before that Court expeditiously without giving unnecessary adjournments to either of the parties if that appeal has not already been decided/disposed of.

Let a copy of this order be sent down to the learned Court below immediately for necessary compliance.

Accordingly, the revisional application being CO/1266/2015 is hereby disposed of.
