The original application was filed on 19th February, 2021 and the last date for filing the application for the post was on 20th February, 2021. The petitioners admittedly, on the basis of the existing Rule, are not eligible to participate. The petitioners have challenged the Rules.

In our view, no explanation has been offered for not challenging the criteria laid down in the advertisement on 20th January, 2021 immediately after the petitioners were aware of it. The learned Tribunal has not dismissed the original application on merits. It has only refused to pass any interim order. The discretion exercised by the learned Tribunal does not call for any interference.

On such consideration, the petition accordingly stands dismissed. However, there shall be no order as to costs. (Amrita Sinha, J.) (Soumen Sen, J.)
