Commercial quantity of codeine mixture was recovered from the joint possession of the petitioner and other co-accused persons. In view of the restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, we are not inclined to entertain the petitioner's prayer for bail. The petitioner says that he is in custody for more than 300 days. Charge is yet to be framed.

We are told that September 28, 2021 has been fixed as the date for consideration of charges. We request the learned Trial Court to expedite the consideration of charges and generally bring the trial to an early conclusion to the extent the business of the court may permit.

Accordingly, the application for bail being CRM 4369 of 2021 is dismissed.
