REJECTED C.R.M.(A) 1402 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Santipur Police Station Case No. 353 of 2024 dated 26.03.2024 under Sections 306/34 of the Indian Penal Code. And In Re : Riju Sarkar @ Arit Sarkar ...... petitioner Mr. Sankar Halder ...for the petitioner Mr. Rana Mukherjee, Ld. A.P.P., Ms. Purnima Ghosh .... For the State Apparently, the victim committed suicide.

Post mortem report of the victim also contains details of injuries that the victim suffered prior to his death. There are statements recorded under Section 164 of the Cr.P.C. which implicate the petitioner amongst other persons assaulting the victim prior to his death. The victim committed suicide immediately thereafter.

In view of the involvement of the petitioner in the incident of assault and thereafter the victim committing suicide, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected.
