Mr. Amit Prakash Lahiri Mr. Soumyadip Chakraborty Mr. Prosenjit Mukherjee ..for the petitioner Mr. Soumyajit Bhatta ..for Panihati Municipality The petitioner claims to be the co-owner of the premises at 14, Dr. Saroj Mukherjee Road, Agarpara, Post Office-Kamarhati, P.S. Khardah, North 24 Parganas. He alleges unauthorised construction at the behest of respondent nos. 8, 9 and 10 at his adjacent premises.

It has been alleged by the petitioner that the construction deviates from the sanctioned plan and does not maintain the mandatory side open space. The petitioner alleges that despite submitting representations, Panihati Municipality has not taken any steps.

In that view of the matter, the writ petition is disposed of with a direction upon respondent no.2 to consider the representation dated February 17, 2024,

appearing at page 74 of this writ petition in accordance with law within a period of two months from the date of communication of this order.

After giving an opportunity of hearing to the petitioner and all concerned, respondent no.2 shall pass a reasoned order and communicate his decision within one week thereafter.

Accordingly, WPA 11051 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
