Kausik CRM (NDPS) 917 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Joypur Police Station Case No. 90 of 2025 dated 22.05.2025 under Sections 20(b)(ii)(C) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year and 1 month and it has been alleged that the petitioner was in possession of about 37 Kgs. of Ganja. Charge sheet has already been submitted. However, till date charges have not been framed. Learned advocate for the State opposes the prayer for bail and submits that, date has been fixed on 30th June, 2026 for consideration of charges.

Having considered the stage of the case, I direct the learned Trial Court to complete the process of consideration of charges on the next date or within a fortnight thereafter. Priority be given to the evidence of the seizure list witnesses.

Having considered the period of detention of the present petitioner, learned Trial Court would, within a period of 2 months from the date of consideration of charges, complete the evidence of the seizure list witnesses and thereafter if the evidence so reflects, leniently consider the prayer for bail of the present petitioner.

With the aforesaid observations CRM (NDPS) 917 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
